1. What is a PLUA?
A Permissive Land Use Agreement (PLUA) is a legal document between the Teal Lake Village Association (TLVA) and a Lot owner. It grants the Lot owner a license to use a specific portion of the Limited Common Area (Encroachment Area) that abuts their Lot, subject to certain conditions and restrictions.
2. Who owns the Limited Common Area?
The Limited Common Area, including the Encroachment Area covered by a PLUA, is owned by the Association. The PLUA does not grant ownership rights to the Lot owner.
3. What can a Lot owner use the Encroachment Area for?
The Encroachment Area may only be used for placement, maintenance, upkeep, and repair of landscaping, related improvements, and yard furniture. Any other use or improvements require express written consent from the Association.
4. Can a Lot owner build permanent structures in the Encroachment Area?
No, additional improvements or personal property cannot be placed or constructed in the Encroachment Area without written approval from the Association. Approval is at the sole discretion of the Association and must comply with design standards and other regulations.
5. Who is responsible for maintaining the Encroachment Area?
The Lot owner is solely responsible for maintaining the Encroachment Area, ensuring it is neat, safe, and well-maintained. Any expenses related to maintenance are the Lot owner’s responsibility.
6. Does the Association have the right to enter the Encroachment Area?
Yes, the Association can access the Encroachment Area during normal business hours for compliance inspections, removal of unauthorized improvements, or maintenance if the Lot owner fails to do so. Any associated expenses will be charged to the Lot owner.
7. Can a Lot owner claim ownership of the Encroachment Area?
No, Lot owners and their successors cannot claim ownership of the Encroachment Area or any portion of the Limited Common Area under the doctrine of Adverse Possession or any similar theory.
8. What liabilities does the Lot owner assume?
The Lot owner agrees to hold the Association harmless from any claims, demands, legal actions, or expenses related to the use or occupancy of the Encroachment Area. This includes liability for any personal injury, property damage, or other claims arising from their use of the area.
9. Are irrigation systems allowed in the Encroachment Area?
Yes, but any residential irrigation system extended into the Encroachment Area is at the owner’s expense, including all maintenance costs.
10. What happens if a Lot owner sells their property?
The Lot owner is responsible for disclosing the terms and conditions of the PLUA to any future buyers. TLVA is not liable for any failure to disclose.
